Thank you for considering buying a Will from Speciality Wills using this form on my web site.

The cost of a Will is £40 for a single will, £50 for a pair of Mirror Wills. This is for a Will written by you and vetted by me, a Professional Will Writer. When you compare this to other offers on the Internet it represents incredible value for money. Most of the other so called Will writing web sites just take your information and the computer churns it out in to a Will you download and print out yourself. My Wills are vetted, drafted and finally posted to you ON ACID FREE PAPER. and come with full step by step instructions on how to get your Will signed and witnessed.

It is assumed that you have familiarised yourself with the page setting out what we do after you have completed this form. If you have not then please have a look now.

Before you complete the form please have a read of my Terms and Conditions page. I will ask you to confirm you have read it towards the end of the form.

Now I know that people don't bother to read these terms and conditions pages, and whilst I am going to say you really really should, what it says is that I am going to write your Will(s) on the basis of the information supplied and once you have it, if you make it invalid by not following the instructions regarding getting it signed and witnessed in the correct manner I am not responsible.

You may NOT use this form where the Will is complicated by the setting up of trusts for a specific reason, e.g. disability. If this is the case please move to my contact page and request that I telephone you and discuss your requirements. This is because I have to be satisfied that you know what is involved in setting up a trust and that the kind of trust to be arranged would be in the best interests of all parties.

‘If you are in a second relationship and wish to know about Tenants in Common and how a Property Trust can GUARANTEE that your share of the home goes to your children and can’t be given away by your new spouse if you should die first, then please do NOT use this form, and please contact us to discuss this matter.’

You may NOT use this form if you have a business that you wish to pass to a beneficiary. If this is the case please move to my contact page and request that I telephone you and discuss your requirements.

Please now complete ALL the boxes below. Some of the information is not actually needed to write your Will but it helps me have a fuller picture of your circumstances. By example, having your date of birth helps me trace your file if I need to call it up again, and equally you have to be over 18 to make a Will.

Please now name up to FOUR executors, where names and addresses are preferable. (Note, if all assets are to pass to surviving spouse then it is a good idea to name the surviving spouse and the first executor here. For Mirror Wills simply state "Surviving spouse" and we will do the rest!)

We recommend you name at least two
Section on executors (help)

It will be assumed that the executors will be asked to act in the order you have listed above, in other words if the first person named has either died or is unable/unwilling to act then the next on the list will be asked. If you have any comments on this please make them here e.g. those named as 3rd or 4th choice should only act together as joint executors

In regards the above executors please now answer the question opposite

Please now name ALL children of the Testator(s). Include names, ages (D.O.B.) and sex.

Please now name any children the Testator(s) have OUTSIDE of the present partnership/marriage. Also which named child belongs to which party in the event of this being a mirror will.. Include ages (D.O.B.) and sex.

Please now name any guardians who would have to look after minor children (under 18) after the death of both partners. Please also suggest alternative guardians should the first named not be able to act.
Section on guardians (help)

You should name your children in your Will, as this would prevent "unknown" or illegitimate children from making any claim on your estate. Please bear in mind if you have any more (!) then you should update your Will to reflect this!

Do not use this section for legacies of money

Please now list any specific legacies to specific people. By example my stamp collection to my next door neighbour (named). Please provide clear information.

(If this form is for Mirror Wills (e.g, Husband and wife) both parties should me mentioned. e.g. Husband - Gold Rolex Watch to my son, (named) Wife - None.)

If NONE state NONE

Does this gift go to the beneficiary whenever you die- i.e. first or last, or does it only go to the beneficiary when you are both deceased?

Please use this section for legacies of money

Please now list any specific legacies to specific people. By example £100 to my good friend (named). Please provide clear information.

(If this form is for Mirror Wills (e.g, Husband and wife) both parties should me mentioned. e.g. Husband - £100 to my favourite charity, (named) Wife - None.)

If NONE state NONE

Does this gift go to the beneficiary whenever you die- i.e. first or last, or does it only go to the beneficiary when you are both deceased?

The Residue. This is the remainder of your estate excluding the above. The normal arrangement here is that it passes to your SPOUSE AND ON THEIR DEATH, to your children equally. Property jointly owned does NOT form part of the estate and so passes automatically to the other party.
Please answer this question very carefully.

Is it your intention that the residue of your estate passes first to the surviving partner/wife and then pass on to surviving children.

If this is a Mirror Will, does that answer apply to both parties

Normally, should a child pre-decease both parents then any children (so your grandchildren) of that child would get their parents share. By example, if you have two children and one has died after themselves having two children the surviving child of yours would get 50% of the remaining estate, and the grandchildren 25% each

Are these your wishes

Please now name your main beneficiaries clearly, state relationship to you, state percentage of remaining estate they are to inherit.

Example - Susan Smith, Wife 100% OR if she has already died.......

James Smith, Son, 25%, Susan Smith, Daughter, 25%, Anthony Brown, son by first marriage, 25%, Connie Jones, Daughter by second marriage 25%

The total MUST come to 100%!

For Mirror Wills these MUST be the same!

Exclusions

If you have deliberately excluded someone from your Will who may have a possible claim on your Estate, it is advisable to write a short explanation in your own hand giving your reasons and to store this letter with your Will. The reasons given must be factual, i.e. I have not supported this person since we divorced/separated etc.

If NONE state NONE

Do you wish to specify your funeral arrangements ?

(Requests can be recorded in your Will but friends and relatives should also be informed separately.
Your Executors are not under any obligation to carry out your wishes. )

Do you wish to leave your organs for transplant purposes

Is there any part of your body you do NOT wish to leave for transplant purposes. If NONE state NONE. Or make any general comments on this subject
